No statement contained in this chapter shall be construed as preventing any special agreement or arrangement between the Village and an industrial user. The Village reserves the right to enter into special agreement with an industrial user setting out special terms under which they may discharge to the POTW. This may include the Village accepting industrial waste of unusual strength or character. Sewer/wastewater treatment charges for industrial users shall be set in accordance with title 8, chapter 8, or as outlined in said special agreement. All charges shall be in accordance with Federal and State guidelines for user charge systems.
Acceptance of industrial waste per special agreement shall in no case waive compliance with a categorical pretreatment standard or Federal pretreatment requirement. However, users may request a net/gross adjustment to a categorical standard in accordance with 40 CFR 403.15. They may also request a variance from the categorical pretreatment standard from the administrator in accordance with 40 CFR 403.13. (Ord. 701, 12-8-2020)
