8-13-2-5: LOCAL LIMITS:
   A.   The Village is authorized to establish local limits pursuant to 40 CFR 403.5(c).
   B.   The pollutant limits established in this section are intended to protect against pass through and interference at the Village's wastewater treatment plant.
   C.   The pollutant limits shown below are for heavy metals and other pollutants.

   The pollutant limits shown below are for conventional pollutants. Significant industrial users will by agreement be allocated an average daily flowrate (based on a thirty (30) day running average) and a maximum daily flowrate. Significant industrial users will be subject to the pollutant limit concentrations shown below along with the corresponding loading for each pollutant that is calculated using the significant industrial user's allocated average daily flowrate.

   Discharges in excess of the pollutant limits detailed in this section shall be subject to enforcement actions and other penalties outlined in this chapter, individual wastewater discharge permits, and industrial user agreements.
   D.   The local limits detailed in this section apply at the point where the wastewater is discharged to the POTW unless dilution beyond typical domestic flows occurs between the end of the process/pretreatment and discharge to the POTW. If significant dilution occurs local limits will apply at the point where the process/pretreatment ends.
   All concentrations for metallic substances are for total metals unless indicated otherwise. The Village may impose mass limitations in addition to the concentration based limitations above. Where a user is subject to a categorical pretreatment standard and a local limit for a given pollutant, the more stringent limit or applicable pretreatment standard shall apply.
   Compliance with the above local limits shall be required no later than three hundred and sixty five (365) days following the effective date of this chapter.
   E.   The Village may develop best management practices (BMPs), by ordinance or in individual wastewater discharge permits, to implement local limits and the requirements of section 8-13-2-1. (Ord. 701, 12-8-2020)
