10-1-2: PRELIMINARY APPROVAL BY VILLAGE BOARD:
   A.   Preliminary Plat Submission: Whenever the owner of any tract or parcel of land within the corporate limits of the village wishes to make a subdivision of the same, he shall cause to be prepared a preliminary plat of said proposed subdivision and shall submit three (3) copies of said preliminary plat together with such other information as may be pertinent thereto to the village board for its preliminary study and approval. The preliminary plat shall contain such information and be in such form as is outlined in section 10-1-3 of this chapter.
   B.   Preliminary Plat Approval: The village board shall study the preliminary plat to see if it conforms with the minimum standards and requirements as outlined by this chapter, and shall approve or reject such plat within forty five (45) days after the date of submission thereof. If the village board does not act upon the same within forty five (45) days, the preliminary plat shall be deemed to be approved; however, the subdivider may agree to an extension of time for an additional time not to exceed sixty (60) days. The approval of the preliminary plat by the village board shall constitute authorization to proceed with the preparation of the final plat and with the installation of the necessary improvements therein as set forth in section 10-1-4 of this chapter.
   C.   Proposed Plat: Where a tract of land is proposed for subdivision and the village board finds that the same would constitute a part of a larger logical subdivision in relation to the existing development of the village, the village board may cause to be prepared a proposed possible plat of the entire area to be used by the village board as an aid to village planning, and specifically in judging the proposed plat filed by such owner.
   D.   Fees:
      1.   Conditions: To help cover the cost of supervisory personnel, plat examination, filing, recording and other expenses incidental to the approval of a subdivision, the subdivider shall pay a fee at the time of application for approval of a preliminary plat. Such fee shall be based on the projected number of lots to be created, with a minimum fee of one hundred fifty dollars ($150.00) for each application for a subdivision. At the time of application for approval of the final plat or the last portion thereof, the required fee will be recalculated on the basis of the actual number of lots created and all adjustment of the fee will be made, the subdivider to pay an additional amount or to receive a refund. There shall be no refund of any portion of the fee if the subdivider fails to apply for final approval of the subdivision or if the preliminary plat expires. In addition, the subdivider shall be responsible for the fees incurred by the village for the services of the village engineer in connection with the plats prepared by the subdivider and for the village engineer's document review of the subdivider documents.
      2.   Amount: The fee collected by the village clerk shall be paid by check or money order and made payable to the village. The fees shall be calculated as follows:
      Number Of Lots      Fee
      From 1 to 10         $20.00 per lot
      For every lot over 10   1.00 per additional lot
There shall be a minimum $150.00 application fee for each subdivision application.
   E.   Other Information Required: The subdivider shall also submit to the village board for its approval or rejection in the same manner as the preliminary plat, a final plat of the proposed subdivision, which shall contain the data and information outlined in section 10-1-3 of this chapter. If the village board approves the plat, such approval and the date thereof shall be noted on the plat over the signature of the village president or the village president pro tempore. Such acceptance by the village board as herein specified shall constitute an acceptance of all streets, alleys, ways, easements, parks, or other areas preserved for or dedicated to the public.
