8-1-14: DEPOSITS ON STREETS, SIDEWALKS:
   A.   Deposits, Deliveries On Streets, Sidewalks:
      1.   It shall be unlawful for any person to deposit, or to permit to be deposited, upon any public way in the village, including any public street or sidewalk, any rubbish, trash, or debris; any mud, dirt, cement, concrete, gravel, stones, plant matter, including grass clippings; any snow from snow removal operations; or, any material which may cause damage to said sidewalk or street, which may be a hazard to persons, animals, property or vehicular traffic, or which may impede the flow of stormwater.
      2.   Exception to subsection A1 of this section shall be made for leaves raked into the curb from the terrace area (only). Also, snow from the sidewalks in the four (4) downtown blocks that comprise the downtown business district may be pushed onto the street for removal by the village snowplows.
      3.   Any person who shall clear or remove any snow, ice, or other precipitation from any sidewalk, private drive, driveway or parking lot, on or adjacent to his or her property, shall clear or remove same to a location on his or her property only, and shall not clear or remove same onto or upon any public property.
      4.   Merchandise or other articles may be deposited for not more than one-half (1/2) hour on a sidewalk, if preparatory to delivery; provided, the usable width of the sidewalk shall not thereby be reduced to less than four feet (4').
      5.   a. Construction materials may be deposited on streets preparatory to delivery for use; provided, that such deposit does not reduce the usable width of the street or roadway at that point to less than eighteen feet (18'), and provided that such materials shall not be permitted to remain on such street for more than six (6) hours.
         b.   Any such construction materials shall be guarded by lights if the same remains upon any street or sidewalk during nighttime.
      6.   In no event shall any person at any time cover or block access to any fire hydrant in the village.
      7.   In the event any person depositing any material on a public way in violation of this section fails or refuses to immediately remove it, the street superintendent may cause the material to be removed. The cost incurred by the village for such removal and all expenses incurred in connection therewith shall be assessed against the property and/or the person who deposited the material. Assessment of such costs against the person who violated the provisions of this section shall not be construed as a waiver of the right of the village to file a complaint against such person and/or to request that a fine be imposed upon conviction.
   B.   Violation: Any person who violates any provisions of this section shall be subject to a fine not less than seventy five dollars ($75.00), and not more than seven hundred fifty dollars ($750.00) for each offense, and a like fine or penalty for each day said violation continues.
