It shall be unlawful for any person under the age of eighteen (18) years to purchase tobacco, or to misrepresent their identity or age or use any false or altered identification for the purpose of purchasing tobacco.
The penalty for the violation of this section shall be a fine not to exceed fifty dollars ($50.00) for a first offense and a fine not to exceed five hundred dollars ($500.00) for a second or any subsequent offense. In addition to or in lieu of a fine or any other penalty assessed upon an admission or finding of guilt under this section, a final disposition may include community service, education alternatives or any similar programs.
