6-2-5: DANGEROUS PREMISES, ACTS, WRECKED, JUNKED OR DISCARDED VEHICLES:
   A.   Premises: It shall be unlawful to permit any building, structure or place to remain in such a condition as to be dangerous to the public health in any way. Any such structure, building or place is hereby declared to be a nuisance.
   B.   Acts: It shall be unlawful to commit or do any act which endangers the public health or results in annoyance or discomfort to the public. (Ord. 258, 12-4-84)
   C.   Wrecked, Junked or Discarded Vehicles:
      1.   Definitions:
    JUNKED VEHICLE Any vehicle defined herein, not licensed for the current year as required by law or having one or more of the following characteristics:
            (1)   Broken or cracked windshield, window, headlight, taillight or any other cracked or broken glass;
            (2)   Deflated tires; or
            (3)   Inoperable because of its state of disrepair or defective condition.
   VEHICLE Every device, in, upon or by which any person or property is or may be transported or drawn upon a public or private road or highway, except devices moved by human power, devices used exclusively upon stationary rails or snowmobiles as defined in the Snowmobile Registration and Safety Act.
      2.   Wrecked, junked or discarded vehicles are hereby declared to be nuisances and no person in charge or control of any property within the Village, whether as owner, tenant, occupant, lessee, or otherwise, shall allow any partially dismantled, nonoperating, wrecked, junked or discarded vehicle to remain on such property longer than seven (7) days, except that this paragraph shall not apply with regard to such vehicle when it is in an enclosed building or when it is on the premises of a business enterprise operated in a lawful place and manner and when necessary to the operation of such business enterprise.
      3.   The Chief of Police or any member of his Department designated by him is hereby authorized to abate such nuisance and may enter upon private property at all reasonable hours for the purpose of inspecting such vehicle, posting notice thereon, and removing and impounding such vehicle. The owner of the vehicle shall be responsible for all towing and storage costs and shall pay same before such vehicle is released to his custody or possession.
      4.   Anyone convicted of violating the above provisions shall be fined not less than seventy five dollars ($75.00) nor more than five hundred dollars ($500.00) for each offense. A separate offense shall be deemed committed upon each day such violation continues. (Ord. 295, 1-3-89)
