4-5-6: DOG WASTE:
   A.   Activity Regulated: It shall be unlawful for any person to fail to promptly remove and dispose of, in a sanitary manner, feces left by a dog being handled by that person on property, public or private, other than the premises of the owner or handler of such dog.
   B.   Exception: It is a specific defense to a charge of violating the above subsection that the dog involved is a certified working dog trained to assist disabled individuals and that the person charged has a disability which prevents the individual from removing the excrement and properly disposing of it in a sanitary manner.
   C.   Penalties: Any person found to be in violation of this section shall be fined not less than twenty five dollars ($25.00) nor more than one hundred dollars ($100.00) for a first violation of this section and not less than fifty dollars ($50.00) nor more than two hundred dollars ($200.00) for a second and each subsequent violation of this section.
