4-5-3: IMPOUNDMENT; REDEMPTION FEES:
Any dog found in the village in violation of any of the provisions of this chapter shall be impounded by any police officer or such person as may be designated by the village board and placed in the village pound or other suitable place, including placement within the custody of the Jo Daviess County health department, pursuant to the rules and regulations of said health department. The village clerk shall, not later than seven (7) days following the impounding of such dog, notify the owner of the dog in writing, if known, and if the owner of the dog is not known, by publishing once in a newspaper published in the village a notice describing the dog and the place and time of taking said dog. Unless the dog is redeemed and all charges paid as herein provided, said dog may be sold or destroyed in the most humane manner possible after the expiration of fourteen (14) days from the time the dog is impounded; provided, however, that any dog which appears to be suffering from rabies or other dangerous disease shall not be released but may be destroyed as soon as compatible with the health laws of the village 1 . Only a person responsible for the impounding of dogs shall release any impounded dog and then only upon receipt of evidence that the following charges have been paid to the village clerk:
Five dollars ($5.00) for the impounding fee, three dollars ($3.00) per day for each day, or any part thereof, said dog was impounded, and the cost of the newspaper publication, if any; provided, however, that any dog placed within the custody of the Jo Daviess County health department shall be released only after the payment of any additional fees charged by said health department.
It shall be lawful for the chief of police to kill any vicious dog at large within the limits of the village, which cannot be taken up and impounded. (Ord. 256, 12-4-1984)
