4-4-8: DOG, CAT OR OTHER ANIMAL WASTE:
   A.   It shall be unlawful for any person to fail to promptly remove and dispose of, in a sanitary manner, feces left by a dog, cat or other animal on property, public or private, other than that of the owner or handler of such animal.
   B.   It shall be a specific defense to a charge of violating subsection A of this section that the animal is a certified working dog trained to assist disabled individuals and that the person charged has a disability which prevents the individual from promptly removing the excrement and disposing of it in a sanitary manner.
   C.   Any person found guilty of violating the provisions of this section shall, upon conviction, be fined no less than seventy five dollars ($75.00) for a first offense and no more than two hundred fifty dollars ($250.00) for a second or a subsequent offense. (Ord. 447, 2-14-2006)
