(a) No person shall erect, set up, place, retain or maintain, any permanent awning or covering extending over any street, alley, sidewalk or public place in the City, without having obtained permission from the City to do so.
(b) Any person desiring to erect, set up, place, retain or maintain, any awning or covering as set forth in subsection (a) hereof, shall file before Council a petition in writing, signed by the petitioner, in which shall be stated the kind, height above ground, dimensions and specifications of the awning or covering desired to be erected, set up, placed, retained or maintained. The petitioner shall keep such awning or covering in good order and repair; and such awning or covering shall be removed at any time the City shall so direct. The petitioner shall erect, set up, place, retain and maintain such awning or covering subject to all the provisions of this section and further, if the petition is granted by Council, the petitioner shall pay to the City a permit fee in the amount of two dollars ($2.00) for each and every such awning or covering, payable annually on or before July 1, for the fiscal year commencing on July 1, and ending on June 30. Such permit fee shall be paid in the office of the City Recorder.
(c) Every awning or covering so erected shall be erected from plans to be approved by the City Manager; shall be from time to time inspected by the City Manager; and shall remain at the pleasure of the City.
(d) Each day that an awning or covering forbidden by this section is maintained, and each day that an awning or covering is maintained without repairs after forty-eight hours from the time the owner thereof has been notified by the City Manager to repair the same, and each day that any awning or covering is maintained after forty-eight hours from the time the owner thereof has been notified by Council to remove same, shall constitute a distinct and separate offense.
