531.03 OPERATION WITHIN THE CITY.
   (a)   No person, firm, company or corporation shall operate any trains through the City unless such person, firm, company or corporation shall erect warning signals or devices at all railroad crossings within the City at the following specified intersections: Cherry Street, Clay Street, Washington Street, George Street, Lafayette Street and Creel Street.
   (b)   No person, firm, company or corporation shall permit any train to travel at a speed in excess of five miles per hour when such train enters the City limits from the south end of the Municipality traveling north from Creel Street to Clay Street and when such train enters the City limits from the north end of the Municipality traveling south from Clay Street to Creel Street. No train shall travel at a speed in excess of ten miles per hour through the remainder of the City limits.
   (c)   No person, firm, company or corporation shall cause any debris or any material to fall from its railroad train engine or railroad cars in the City.  In the event that such debris or material falls from any railroad train and is not cleared within two hours of the incident, the City Manager shall cause same to be cleared and cleaned and shall submit a statement to the railroad company for the City services to be paid within thirty days of the incident.
   (d)   Any person, firm, company or corporation shall mow and keep clean all of its property, as well as maintain the railroad tracks clear of all debris and other material within the City.
   (e)   No train switching shall occur on Second Street in the City between the hours of 8:00 a.m. and 9:00 a.m., 12:00 p.m. to 1:00 p.m. and 5:00 p.m. to 6:30 p.m. in order to avoid an unreasonable obstruction to the traffic thereon.
   (f)   No railroad train shall carry more than one hundred railroad cars passing through the City at any one time in order to avoid an unreasonable obstruction to the traffic thereon.
   (g)   No person, firm, company or corporation shall operate railroad trains through the City unless such person, firm, company or corporation shall inform the City Manager in advance the type of material and chemicals being transported through the City in order that the City Manager can notify representatives of the Fire Department to have the necessary materials and equipment on hand to use for the health, safety and welfare of the citizens of the City in case of any train derailment or any emergency.
   (h)   Any person, firm, company or corporation operating railroad trains through the City shall be responsible for maintaining the railroad tracks in good repair and shall repair and shall replace loose ties, spikes or blacktop adjacent to the tracks.
   (i)   No person, firm, company or corporation shall cause or permit to be caused any unnecessary noise, including but not limited to whistle blowing, bumping of railroad cars and unattended locomotive running from 10:00 p.m. to 7:00 a.m.
   (j)   The City Manager is authorized to stop all train traffic through the City for the health, safety and welfare of the citizens in the event that any damage has occurred to the railroad tracks or ties until repairs are made to same to the specifications and satisfaction of the City Manager.
   (k)   No person, firm, company or corporation shall operate railroad trains through the City unless the City Manager is furnished in advance a time schedule of the traffic operating throughout the City and is further notified of any changes in such schedule.
   (l)   No person, firm, company or corporation shall permit, or cause to be done any unhooking of any railroad cars from the engine during switching in the City or allow any railroad cars to run loose or coast on their own, nor shall any engine be left running unattended.
   (m)   No person, firm, company or corporation shall block, or cause to be blocked, any roadway within the City, or within one mile of the City, unless same is done for emergency maintenance purposes and in that event the blocking shall not take place in the downtown area between Clay Street and Creel Street and in no event shall such blocking be for a period in excess of one hour.
   (n)   No person, firm, company or corporation shall cause any repairs to be made in the City without first obtaining from the City Manager a written permit, stating specifically what repairs shall be made and the length of time involved in making such repairs.
   (o)   No person, firm, company or corporation shall close both sides of any streets within the City whenever any repairs are being made to railroad tracks unless duly authorized in writing by the City Manager.
   (p)   No person, firm, company or corporation shall make any repairs, unless appropriate signs are first erected for the safety and welfare of the citizens designating “work areas” and “men working”.
   (q)   No person, firm, company or corporation shall operate trains through the City unless an annual inspection of the railroad tracks and property adjacent thereto, for the health, safety and welfare of the citizens, shall occur on or before July 1, of each year hereafter by a representative of such person, firm, company or corporation and by the City Manager.
   (r)   In the event it shall become necessary for any person, firm, company or corporation to make unnecessary repairs to railroad tracks or adjacent property upon notice by the City Manager, such person, firm, company or corporation shall inform the City Manager within twelve hours of his notification the proposed action anticipated by such person, firm, company or corporation.
   (s)   No person, firm, company or corporation shall place or permit to remain in or on any public street or alley in the City any nail, spike, cross-tie, rail or other object which endangers the public safety or is dangerous to vehicular or pedestrian traffic upon the street  or alley or permit any obstruction, structure, device or other object otherwise lawfully maintained in or on any street or alley of the City to depreciate or become in disrepair to such an extent that the same endangers the public safety or is dangerous to vehicular or pedestrian traffic upon the street or alley.  (Passed 5-17-77.)
