149.01  VACANCY; REMOVAL AND SUSPENSION FROM OFFICE.
   (a)   Vacancy in Office of Mayor or Council; Election of Successor.  If a vacancy occurs in the office of the Mayor or a member of Council, the remaining members of Council shall elect a person to fill such vacancy during the balance of the unexpired term.
   (b)   Vacancies in Other Offices.  If any vacancy shall occur in any office, the incumbent of which, under the Charter, is elected or appointed by Council, such vacancy shall be filled by Council as it shall see fit.
   (c)   Suspension of Mayor and Councilmen.  Neither the Mayor nor any member of Council shall be suspended from office except for official misconduct, incompetency, neglect of duty or gross immorality, and then only by Council and during the period pending the hearing of written charges preferred for the purpose of removing him from office.
   (d)   Removal of Mayor and Members of Council.  The Mayor or any member of Council may be removed from office in the method provided in Section 4 of the Charter, for official misconduct, incompetency, neglect of duty or gross immorality by the affirmative votes of three-fourths of the remaining members of Council, upon written charges preferred by any responsible person.  (1972 Code §2-5-1 to 2-5-4)
