139.06 LEASING AGENT.
   (a)   Pursuant to the home rule powers designated under the Ohio Constitution, the Director of Public Service and Safety is hereby designated as the leasing agent of the City of St. Marys.
   (b)   The Director of Public Service and Safety shall certify to the Auditor of the City a list of those properties that are available for lease, and such list shall be available for public inspection in the Auditor’s Office. This list shall hereinafter be referred to as the “Lease List”.
   (c)   The Director of Public Service and Safety shall be authorized to enter into a lease agreement for property on the Lease List, said lease agreements not to exceed two years in duration.
   (d)   Prior to entering into a lease agreement for a property on the least list, the Director of Public Service and Safety shall make an investigation as to the prevailing lease rates for similar situated property within the community. Such leases shall be in conformity with prevailing lease rates as is shown by such investigation.
   (e)   Upon entering into a lease arrangement, the terms and conditions of said lease arrangement shall be made a part of the Lease List which shall be kept on deposit with the City Auditor.
   (f)   Council may specifically waive any provision of this section by resolution or ordinance.
