(a) The consent of the City is hereby given to one F-1 or F-2 permit for the sale of beer only in the Baughman Stadium Complex during a weekend of August of each year for the purposes of holding an annual “Summerfest” celebration. Such celebration shall not exceed eighty hours. The sale of such beer is to be conducted in accordance with the regulations of the Ohio Department of Liquor Control. The permit area in the Baughman Stadium Complex shall be an area bounded on the west by Front Street; on the south by the RJ Corman Western Ohio Lines (RJCW) railroad tracks; on the east by the St. Marys River; and on the north by South Street.

(b) The permit area shall be enclosed by a significant barrier which shall encourage ingress and egress to and from the permit area only through marked entrances. The barrier and the entrances shall be marked with appropriate signage indicating that beer shall only be consumed within the permit area.
(c) A report on the financial condition of the Summerfest celebration shall be made to Council within 120 days of the conclusion of the annual festival. Such financial report shall include a statement of receipts and expenditures and a statement of the assets and liabilities of the Summerfest committee. Further, the various departments of the City shall cooperate as much as is possible with the Summerfest committee in order to assure a safe, orderly and successful annual celebration. Application for the closing of streets for the period of the Summerfest celebration shall be made in the same manner and under the same procedures as applying for a parade permit under Section 311.02 of the Traffic Code.
(d) As used in this section, a "significant barrier" shall at a minimum consist of two strands of rope, one of which shall be at least four feet off the ground and the other which shall be at least two feet off the ground.
(e) The consent of Council allowing the sale of beer is granted on the condition that the Summerfest committee remain under the direct supervision of the St. Marys Area Chamber of Commerce.
