951.01 DEFINITIONS.
   As used in this chapter and in the Penal Laws, except as otherwise provided:
   (a)    "Garbage" means all putrescible wastes, animal or vegetable, attending or resulting from the preparation, dressing, use, cooking, retail or wholesale dealing in or storing of meat, fish, fowl, fruits, vegetables and all other food stuffs including spoiled foods, except offal from slaughter houses and retail butcher markets. The term also includes all similar substances from public and private establishments and from all residences.
   (b)    "Refuse" means trash and rubbish and generally including anything worthless or useless, such as items that are broken, torn and not repairable and by way of example but not in limitation meaning ashes, broken glass, used tin cans, broken crockery, paper boxes, rags, old clothing, used tires, pieces of metal, and generally including all other similar nonputrescible wastes. The term rubbish does not include tree limbs or any material such as earth, sand, brick, stone, concrete, plaster or other similar substances that may accumulate as a result of construction operations.
   (c)    "Head of household" means the head of a family unit or one maintaining separate living quarters and shall include owners, tenants, and occupants of all premises where garbage and refuse, or both, is created. Head of household shall not be construed as a commercial operator as defined below.
   (d)    "Premises" means land or buildings, or both, or parts of either, occupied by a head of household or commercial operator.
   (e)    "Commercial operator" means all persons, firms or corporations who own or operate stores, restaurants, industries, institutions or similar public or private places, whether charitable or noncharitable, and includes all responsible persons other than head of households, upon the premises in which garbage or refuse is created.
   (f)    "Collection Division" means that part of the St. Marys Refuse Department charged with the duty of collecting garbage and refuse.
   (g)    "Container" means garbage cans/hoppers or a like approved device for the temporary storage of garbage and refuse on premises while awaiting collection.
