(a) No person, organization, company or corporation shall make any opening in, or cut into, break, bore, or tunnel under or otherwise disturb any street, alley, sidewalk, curb, gutter or public way of the City unless a permit therefor has been obtained prior to commencement of the work, as herein provided, unless there exists an emergency that endangers life or real property.
(b) Any person, organization, company or corporation that has made application for and been issued a street opening permit shall maintain a standard or sign for displaying such opening permit. The permit shall be displayed as long as the area is unsafe for vehicular or pedestrian traffic. The standard or sign shall be so constructed to protect the permit from the weather, yet remain clearly visible to the public.
(c) If the opening is made under the emergency exception of this chapter, the person, organization, company or corporation that makes such opening shall immediately notify the Police Department. Application for a street opening permit for such opening shall be made the first day after the emergency that the Municipal offices are open for business. Furnishing information on the necessity of the emergency opening shall be a part of the application for such permit.
(d) Every individual, organization, company or corporation that applies for and obtains a street opening permit from the City shall be responsible for maintaining traffic in accordance with the "Ohio Uniform Traffic Control Manual." This applies to signing, providing "flagmen" if necessary and all advance warning and proper placement of barricades, etc.
(e) If such person, company or corporation, etc. is observed not properly maintaining traffic in accordance with the "Uniform Manual" the City shall revoke the permit, require such traffic control or provide the required control and bill the individual for any costs incurred.
