557.01 DEFINITIONS.
   As used in this chapter the following words and terms shall have the meanings ascribed to them herein.
   (a)    "Person" means one or more individuals, corporations, partnerships, associations, labor organizations, legal representatives, mutual companies, joint stock companies, trusts, unincorporated organizations, trustees, trustees in bankruptcy, receivers and fiduciaries.
   (b)    "Employer" includes the State, or any political or civil subdivision thereof, any person employing four or more persons within the State, and any person acting in the interest of an employer, directly or indirectly.
   (c)    "Employee" does not include any individual employed in the domestic service of any person.
   (d)    "Labor organization" includes any organization which exists for the purpose, in whole or in part, of collective bargaining or of dealing with employers concerning grievances, terms or conditions of employment, or for other mutual aid or protection in relation to employment.
   (e)    "Employment agency" includes any person regularly undertaking, with or without compensation, to procure opportunities to work or to procure, recruit, refer or place employees.
   (f)    "Commission" means the St. Marys Human Relations and Fair Housing Board.
   (g)    "Discriminate" includes to segregate or separate.
   (h)    "Unlawful discriminatory practice" means any act prohibited by Section 557.02.
   (i)    "Place of public accommodation" means any inn, restaurant, eating house, barber shop, public conveyance by air, land or water, theater, store or other place for the sale of merchandise, or any other place where the accommodation, advantages, facilities or privileges thereof are available to the public.
   (j)    "Housing" includes any building, facility or structure or portion thereof which is used or occupied or is intended, arranged or designed to be used or occupied as the home, residence or sleeping place of one or more persons, groups or families and any vacant land offered for sale or lease for the construction or location thereon of such building, facility or structure.
   (k)    "Restrictive covenant" means any specification limiting the transfer, rental, lease or other use of any housing because of race, color, religion, national origin, ancestry, or handicap, or any limitation based upon affiliation with or approval by any person, directly or indirectly, employing race, color, religion, national origin or ancestry or handicap as a condition of affiliation or approval.
   (l)    "Burial lot" means any lot for the burial of deceased persons within any public burial ground or cemetery, including but not limited to, cemeteries owned and operated by municipal corporations, townships, or companies or associations incorporated for cemetery purpose s.
   (m)    "Handicap" means with respect to a person:
      (1)    A physical or mental impairment which substantially limits one or more of such person's major life activities.
      (2)    A record of having such an impairment, or
      (3)    Being regarded as having such an impairment, but such term does not include current, illegal use of or addiction to a controlled substance (as defined in Section 102 of the Controlled Substance Act (21 U.S.C. 802)).
   (n)    "Real estate agent" includes any real estate broker, real estate salesman or an agent thereof, or any other person, partnership, association or corporation who for consideration sells, purchases, exchanges, rents, negotiates, offers or attempts to negotiate the sale, purchase, exchange or rental of real property or holds himself out as engaged in the business of selling, purchasing, exchanging, renting or otherwise transferring any interest in real property.
   (o)    "Board" means the St. Marys Human Relations and Fair Housing Commission as created by this chapter.
   (p)    "Familial status" means one or more individuals (who have not attained the age of eighteen years) being domiciled with:
      (1)    A parent or another person having legal custody of such an individual or individuals; or
      (2)    The designee of such parent or other persons having such custody, with the written permission of such parent or other person. The protections afforded against discrimination on the basis of familial status shall apply to any person who is pregnant, or in the process of securing legal custody of any individual who has not attained the age of eighteen.
