11-1-2: DEFINITIONS:
For the purpose of this title, certain terms and words are herewith defined as follows:
ALLEY: A public or private thoroughfare which affords only a secondary means of access to abutting property.
AREA GENERAL PLAN: A general plan prepared by the subdivider, or subdividers, for the progressive development of a large landholding, or several properties proposed to be subdivided by sections, meeting the requirements of these regulations.
BLOCK: Property abutting on one side of a street, and lying between the two (2) nearest intersecting or intercepting streets, or between the nearest intersecting or intercepting street and railroad right-of-way, waterway or other definite barrier.
BOARD: Refers to, and is the same as, the Board of Trustees of the Village of St. Joseph.
BUILDING SETBACK LINE: A line within a lot or other parcel of land so designated on the plat of the proposed subdivision, or as provided in title 10 of this Code, between which and the adjacent boundary of the lot, the erection of an enclosed structure or portion thereof is prohibited. The building setback line shall be parallel with the adjacent street right-of-way line or side or rear yard line, except as otherwise approved by the Board.
COMMISSION: Refers to, and is the same as, the Planning and Zoning Commission of the Village of St. Joseph.
COMMON AREA (COMMON PROPERTY): Those areas and facilities owned, designated and intended for use by all the residents and owners of the development.
COMPREHENSIVE PLAN: An official advisory plan of jurisdiction formally adopted by a municipality or the County, any part of which may be implemented by ordinance duly enacted by the Corporate Authorities as prescribed by the Illinois Municipal Code. Said plan shall be placed on file with the Village Clerk and with the Champaign County Clerk.
DEDICATION: The deliberate appropriation of land by its owner for any general public uses, reserving to himself/herself/itself no other rights than such as are compatible with the full exercise and enjoyment of the public uses to which the property has been devoted.
DEVELOPMENT AGREEMENT: A contract or agreement entered into between the owner of a property and the Village of St. Joseph, which involves a commitment by the owner and/or the Village to contribute funds, effort, or other resources towards the study of the feasibility and/or the actual construction of extensions of sanitary sewers, water mains, storm sewers, street improvements, or other infrastructure improvements needed or desired for the development of the owner's property. It is generally intended that a development agreement, if deemed necessary, be entered into during the area general plan stage of the subdivision approval process.
EASEMENT: A grant by the property owner of either the permanent or temporary use of an area of land to the public, a corporation, or person(s), for specified uses and purposes to be designated as a "public" or "private" easement depending upon the nature of its use. Easements shall be considered permanent unless specified as temporary.
ENGINEER: A professional engineer, registered as such and licensed to practice in the State of Illinois or qualified to practice as provided by the Illinois Compiled Statutes.
LOT: A portion of a subdivision, or other parcel of land intended as a unit for transfer of ownership or for development.
LOT, AREA: The horizontal projection (in square feet) of a parcel of land or a body of water, or combination of both, exclusive of any portion of the right-of-way of any public or private streets. Measurements are to be made by standard surveying practice methods.
LOT, CORNER: A parcel of land at the junction of and fronting or abutting on two (2) or more intersecting streets.
LOT, DEPTH: The average distance between the front and rear line of a lot measured in the general direction of its side lot lines.
LOT, INTERIOR: A lot other than a corner lot.
LOT LINE: The real or imaginary line oriented by a monument or other stable point of reference which indicates the boundary of a lot.
LOT, WIDTH: Shall be as defined in title 10, "Zoning Regulations", of this Code.
OUTLOT: A lot depicted on an approved development plat which normally is not a buildable lot meeting the requirements of the Village of St. Joseph's or Champaign County's zoning ordinances for minimum width, size or frontage requirements. Such lots are usually remnants or unusable portions of land in a development plat. Outlots, unless approved by the Village, may not be developed. An outlot may include any land devoted to a common area as part of a development.
OWNER: Any person having any legal, equitable or beneficial interest in the land sought to be subdivided, including the plural as well as the singular, and firm, association, partnership, private corporation, or combination of any of them.
PLANS: All drawings, including general plans, cross sections, profiles, working details and specifications, which the subdivider prepares or has prepared to show the character, extent and details of the improvements required in this title.
PLAT: A map or drawing showing the lot and street arrangement or other features or details of the area being subdivided, as required in this title for preliminary and final approval and recording.
PUBLIC IMPROVEMENTS: Street pavements, public walkways, monuments, water mains, sanitary and storm sewers, street signs, drainage ditches, culverts, stormwater detention basins, and appurtenances to the foregoing items and for use by the public.
RIGHT-OF-WAY (ROW): The entire dedicated tract or strip of land that is dedicated for use by the public for circulation and/or service.
STREET, ARTERIAL: A public thoroughfare with a high degree of traffic continuity established in the major street plan of the Village.
STREET, COLLECTOR: A street which carries traffic from local and subcollector streets to the arterial street system, including the principal entrance streets of residential developments and the primary circulating streets within such developments.
STREET, LOCAL: Minor streets providing direct access to abutting property which may be devoted to residential, commercial, or other uses. Streets in this classification are not considered part of the major thoroughfare system.
STREET, SUBCOLLECTOR: A street which collects traffic from local streets to either a collector street or an arterial street, and is designed with more emphasis on property access than mobility. Subcollector streets generally include more stub connections than the collector streets.
SUBDIVIDER: See definition of owner.
SUBDIVISION OR SUBDIVIDE: Either: a) the division of a parcel of land into two (2) or more parts, lots, tracts, sites or parcels; or b) the establishment or dedication of a road, highway, street, alley or easement of access through a tract of land regardless of area; provided, however, that the sale or exchange of small parcels of land to or between adjoining property owners, where such sale or exchange does not create any additional lots, shall not be considered as a subdivision of land.
