8-1-10: SIDEWALK PROTECTION DURING CONSTRUCTION:
   (A)   Whenever an application for a zoning permit is submitted to the Village for a new building or addition, the contractor or property owner shall request an inspection of any existing public sidewalk. Upon completion of all such improvements, the contractor or property owner shall again request an inspection of any existing public sidewalk.
   (B)   During construction, the owner of the lot where construction is taking place and the builder shall be responsible for covering the public sidewalk with six inches (6") to eight inches (8") of dirt at the location where construction vehicles will cross over the public sidewalk. Construction vehicles shall not cross over the public sidewalk at any other location than these protected locations. Upon completion of construction and prior to occupancy of the newly constructed improvements, all said dirt shall be removed from the public sidewalk and sidewalk shall be cleaned.
   (C)   The contractor and the property owner shall be jointly and severally liable for any damage to the said sidewalk which occurs between the time of said inspections required by this section, or any damage to public sidewalks where either or both of said inspections were not requested. Any such damage to public sidewalks shall be repaired by the contractor or property owner within thirty (30) days of written notice from the Village Clerk requiring that said repairs be made. In the event said repairs are not completed within said thirty (30) days, or extension thereof approved by the Board of Trustees, then the Village may have said repairs made, in which event the contractor or property owner shall reimburse the Village within thirty (30) days of mailing (by certified mail) of a copy of an invoice for said repairs and demand by the Village Clerk for payment. In the event payment is not received by the Village within said thirty (30) days, a lien may be filed against said property with the Recorder in the amount of the Village's costs of repair. In addition, said contractor and/or property owner, who fails to comply with a demand served upon him or her: 1) shall be guilty of a violation of this section for each day that payment is not received beyond the thirtieth day after said demand for payment is mailed by the Village, and 2) shall not be issued a new zoning permit for any property within the Village until said contractor/property owner is in compliance with this section and demands served hereunder.
