The City Engineer and/or Zoning Administrator (or a city designee) shall have the authority to vary from the strict requirements of this chapter if all of the following conditions are found:
(A) The property has unique physical features or other unique characteristics that make utility installation pursuant to this chapter unfeasible;
(B) Strict application of the provisions of this chapter would be unduly burdensome on the applicant; and
(C) The granting of a variance pursuant to this section would not cause a substantial injustice to nearby properties nor cause public safety concerns.
