(A) No person shall:
(1) Discharge, offer for sale, or possess any fireworks except the type and under the conditions permitted by the Michigan Fireworks Safety Act (M.C.L.A. §§ 28.451 et seq.).
(2) Ignite, discharge, or use consumer fireworks within the geo-political boundaries of the city, as “consumer fireworks” are defined in the Michigan Fireworks Safety Act (M.C.L.A. §§ 28.451 et seq.):
(a) On any day other than New Year's Eve, New Year's Day, but only until 1:00 a.m.; the Saturday and Sunday before Memorial Day until 11:45 p.m.; June 29 through July 4 until 11:45 p.m. each of those days, and also July 5 if said date falls on a Friday or Saturday, until 11:45 p.m.; the Saturday and Sunday before Labor Day until 11:45 p.m. Under no circumstances shall fireworks be ignited, discharged or otherwise used on these days/dates before 11:00 a.m.;
(b) On public or school property, without the express permission of the city or a permit from the city granting such permission to do so; or
(c) On church property or the property of another, without express permission from the property owner.
(3) Fireworks shall not be sold to a minor. No person under the age of 18 years shall use, possess, explode or cause to explode any consumer fireworks, as defined herein, within the city.
(4) Ignite, discharge, or use consumer fireworks, or low-impact fireworks, as defined in the Michigan Fireworks Safety Act (M.C.L.A. §§ 28.451 et seq.), while under the influence of alcoholic liquor, a controlled substance, or a combination of alcoholic liquor and a controlled substance as the terms are defined in the Michigan Motor Vehicle Code (M.C.L.A. §§ 257.1 et seq.).
(B) If a police officer determines that a violation of this section has occurred, the officer may seize the consumer fireworks as evidence of the violation.
