§ 91.07 OPEN BURNING AND RECREATIONAL FIRES.
   (A)   No person, business, corporation, firm or other entity shall burn any leaves, wood, brush, trash, papers, rubbish, garbage or other combustible material out of doors anywhere within the city limits, except as follows.
      (1)   Recreational fires, defined as those outdoor fires for cooking or recreation, are permitted to the extent that there is compliance with the following rules:
         (a)   Only natural cut wood and small brush is permitted for recreational fires.
         (b)   No burning of leaves, garbage, lumber, pallets or sawdust.
         (c)   Fire must be contained by an adequate fire ring or other fire receptacle. Interior dimensions of the fire ring, pit or receptacle may not exceed three feet in diameter.
         (d)   Fire must be attended at all times until completely extinguished.
         (e)   A minimum of 15 feet distance must be maintained from structures or combustible material.
         (f)   A means of extinguishment must be readily available, such as dirt, sand, water barrel or garden hose. Extinguishment source should be comparable to the size of the fire.
         (g)   Extreme caution should be used when weather conditions result in lack of rain for more than a week and/or high temperatures result in dry conditions.
      (2)   The St. Johns Police or Fire Department may order the extinguishment of a recreational fire for any of the following reasons:
         (a)   High winds;
         (b)   Burning material other than cut wood/brush;
         (c)   Citizen compliant for violation of ordinance regulations;
         (d)   Smoke from fire entering a neighboring residence;
         (e)   Unattended fire;
         (f)   The imposition of the “State Burning Ban”;
         (g)   Any potential safety concerns as observed by the St. Johns Fire or Police Department.
   (B)   The use of outdoor (wood-fired or other combustible fuel-fired) furnaces, boilers and stoves are prohibited. Because of the potential for the generation of excessive smoke and other noxious fumes, no person, firm, corporation or other entity shall install, use or maintain an outdoor wood-fired (or other combustible fuel-fired) furnace, boiler or stove within the city.
   (C)   Penalty provisions for violations of this section. Any person, firm, corporation or entity in violation of any provision of this section shall be subject to the penalties of Chapter 36 of this Code, entitled Municipal Civil Infractions.
