§ 90.245 BIRD SANCTUARY.
   (A)   As used herein, the term BIRD SANCTUARY includes an area of land that supports the conservation of year-round and migratory bird species and their natural habitats.
   (B)   A bird sanctuary is hereby created and established within the town to conform with the corporate boundaries thereof pursuant to G.S. § 160A-188.
   (C)   It shall be unlawful for any person to hunt, kill, trap, or otherwise take any protected birds within the town limits except pursuant to a permit issued by the state’s Wildlife Resources Commission. Abandoned bird nests or nests not containing eggs may be removed with the exception of nests made by birds of prey.
   (D)   For birds deemed a nuisance by owners or organizations within the town, all federal and state laws and the sate’s Wildlife Resources Commission rules must be followed.
