(A) Airport Commission.
(1) Establishment and composition. An Airport Commission, composed of five members, is hereby established. All appointments thereto shall be made by the Council for a term of two years.
(2) Powers. The Airport Commission shall not expend any money on the airport without prior consent of the Council, nor shall it rent, or lease, any land on the airport without first obtaining the consent of the Council.
(3) Airport Manager. The Airport Commission may appoint an Airport Manager, and other airport employees, subject to the approval of the Council, and may recommend to the Council the compensation to be paid to the Airport Manager, and other employees.
(4) Rules and regulations. The United States Civil Air Regulations, and the laws of the state pertaining to aeronautics, are hereby adopted by reference, which regulations shall govern the operation of the airport. The Airport Commission may adopt additional regulations; provided, that such regulations shall not conflict with applicable federal, or state, regulations.

(B) Airport Zoning Board of Adjustment.
(1) Establishment and composition. An Airport Zoning Board of Adjustment, composed of the members of the Airport Commission, is hereby established.
(2) Powers. The Airport Zoning Board of Adjustment shall have the following powers:
(a) To hear, and decide, appeals from any order, requirement, decision, or determination made by the City Engineer in the enforcement of the airport zoning regulations;
(b) To hear, and decide, any special exceptions as to airport zoning regulations upon which the Airport Zoning Board of Adjustment may be required to pass under such regulations; and
(c) To hear, and decide, specific variances of airport zoning regulations.
(3) Decisions. The concurring vote of a majority of the members of the Airport Zoning Board of Adjustment shall be sufficient to reverse any order, requirement, decision, or determination of the City Engineer, or to decide in favor of the applicant on any matters upon which it is required to pass under the airport zoning regulations, or to effect any variation in the regulations.
(4) Rules. The Airport Zoning Board of Adjustment shall adopt rules in accordance with the provisions of the city code. Meetings shall be held at the call of the Chairperson, and at such other times as the Board may determine. The Chairperson, or, in his or her absence, the Acting Chairperson, may administer oaths, and compel the attendance of witnesses. All hearings of the Board shall be public. The Board shall keep minutes of its proceedings, showing the vote of each member upon each question, or, if absent or failing to vote, indicating such fact, and shall keep record of its examination and other official action, all of which shall immediately be filed in the office of the City Clerk-Treasurer, and shall be a public record. The office of the City Clerk-Treasurer shall be the office of the Board. Upon their appointment, the members of the Airport Zoning Board of Adjustment shall select a Chairperson to act at the pleasure of the Board.
