§ 53.09 RESIDENTIAL DUMPSTER USE.
   (A)   General. It is not lawful for a single-family residential dwelling unit within the city to use dumpsters for household waste and refuse, except as follows:
      (1)   Businesses. By virtue of a dumpster permit issued by the Building Inspector to businesses operating out of a residential unit who have complied with the applicable zoning ordinances of the city code, and all other applicable city code provisions, rules, and regulations. Any dumpster approved by a dumpster permit shall not be stored within the front yard setback. A dumpster cannot be stored on a grass surface and, in all cases, the dumpster location shall be determined by mutual agreement between the appropriate city building official, property owner, and representative of the contract garbage carrier. If no agreement can be reached, the Building Official’s decision shall be final. Failure to keep the dumpster lid secured, the area around the dumpster clean, the dumpster emptied on schedule, and failure to maintain odor control, will be considered a violation of this section, which may include revocation of the dumpster permit;
      (2)   Residential uses when moving or relocating, removing material for siding, shingling, and/or remodeling. In such circumstances, the owner, or resident, of the premises shall be required to obtain a one-month temporary dumpster permit from the city for the dumpster. Once the one-month period has expired, the dumpster must be removed, or the resident must obtain further permission from the City Building Official. Failure on the part of the owner to have the dumpster emptied on schedule, the lid secured, the area around the dumpster kept clean, and maintain odor control, will be considered a violation of this section, and subject the property owner to the penalties described herein.
   (B)   Dumpster permit. Dumpsters approved by a dumpster permit must be located on private property. Under no circumstances can dumpsters be located on streets, rights-of-way, or alleys.
   (C)   Violation. A person who violates a division herein shall be guilty of a petty misdemeanor.
