339.13 EXHAUST SYSTEM; TRUCK WEIGHING MORE THAN 8,000 POUNDS.
   (a)   A truck with a gross vehicular weight of more than 8,000 pounds is prohibited from racing the motor in such a manner that the exhaust system emits a loud, cracking or chattering noise unusual to its normal operation.
   (b)   A truck with a gross vehicular weight of more than 8,000 pounds is prohibited from using an engine retarder. For the purpose of this section, an “engine retarder” is defined as any type of engine retarder commonly used as a braking system within the trucking industry, including, but not limited to, C Brakes, Pac Brakes, Tek Brakes, and Jake Brakes.
   (c)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
