171.01 DEFINITIONS.
   (a) "Burial lot" means any lot for the burial of deceased persons within any public burial ground or cemetery, including but not limited to, cemeteries owned and operated by municipal corporations, townships or companies or associations incorporated for cemetery purposes.
   (b)   "Commission" means the Fair Housing Practices Commission as set forth and created by this chapter.
   (c)   "Disabled family" means a family whose head (including co-head), spouse, or sole member is a person with a disability. It may include two or more persons with disabilities living together, or one or more persons with disabilities living with one or more live-in aides.
   (d)   "Discriminate" includes segregate or separate.
   (e)   "Elderly family" means a family whose head (including co-head), spouse, or sole member is a person who is at least 62 years of age. It may include two or more persons who are at least 62 years of age living together, or one or more persons who are at least 62 years of age living with one or more live-in aides.
   (f)   “Familial status" means one or more individuals (who have not attained the age of eighteen years) being domiciled with:
      (1)   A parent or another person having legal custody of such individual or individuals; or
      (2)   The designee of such parent or other person having such custody, with the written permission of such parent or other person.
   (g)   "Family" for the purposes of this chapter includes, but is not limited to, the following, regardless of actual or perceived sexual orientation, gender identity, or marital status:
       (1)    A single person, who may be an elderly person, displaced person, disabled person, near-elderly person, or any other single person; or
      (2)   A group of persons residing together, and such group includes, but is not limited to:
         A.   A family with or without children (a child who is temporarily away from the home because of placement in foster care is considered a member of the family);
         B.    An elderly family;
         C.    A near-elderly family;
         D.    A disabled family;
         E.    A displaced family; and
         F.    The remaining member of a tenant family.
   (h)   “Gender identity" means actual or perceived gender-related characteristics.
   
   (i)   "Handicap" means with respect to a person:
      (1)   A physical or mental impairment which substantially limits one or more of such persons' major life activities,
      (2)   A record of having such an impairment, or
      (3)   Being regarded as having such an impairment.
   Such term does not include current, illegal use of or addiction to a controlled substance (as defined in Section 102 of the Controlled Substances Act (21 U.S.C. 802)).
   (j)   “Housing accommodations" includes any building or structure or portion thereof which is used or occupied or is intended, arranged or designed to be used or occupied as the home residence or sleeping place of one or more individuals, groups or families whether or not living independently of each other, and any vacant land offered for sale or lease.
   It also includes any housing accommodations held or offered for sale or rent by a real estate broker, salesman or agent, or by any other person pursuant to authorization of the owner, by the owner or by such person's legal representative.
   (k)   "Military status" means a person's status in "service in the uniformed services" as defined in section 5923.05 of the Ohio Revised Code.
   (l)   "Near-elderly family" means a family whose head (including co-head), spouse, or sole member is a person who is at least 50 years of age but below the age of 62; or two or more persons, who are at least 50 years of age but below the age of 62, living together; or one or more persons who are at least 50 years of age but below the age of 62, living with one or more live-in aides.
   (m)   "Person" includes one or more individuals, partnerships, associations, organizations, corporations, legal representatives, trustees, trustees in bankruptcy, receivers and other organized groups of persons. It also includes, but is not limited to, any owner, lessor, assignor, builder, manager, broker, salesman, agent, employee, lending institution and the City or any political subdivision operating within the City and any of their respective authorities, agencies, boards or commissions thereof.
   (n)   "Place of public accommodation" means any inn, restaurant, eating house, barbershop, public conveyance by air, land or water, theater, store or other place of public accommodation or amusement where the accommodation, advantages, facilities or privileges thereof are available to the public.
   (o)   "Restrictive covenant" means any specification limiting the transfer, rental, lease or other use of any housing because of race, color, religion, sex, national origin, handicap, familial status, ancestry, sexual orientation, gender identity or military status, or any limitation based upon affiliation with or approval by any person, directly or indirectly, employing race, color, religion, sex, national origin, handicap, familial status, ancestry, sexual orientation, gender identity or military status, as a condition of affiliation or approval.
   (p)   "Sexual orientation" means homosexuality, heterosexuality, or bisexuality.
   (q)   “Unlawful discriminatory practice" means any act prohibited by the provisions of this chapter. (Ord. 2012-88. Passed 10-23-12.)
