1305.06 BUILDING SEWER; PRIVATE WASTEWATER DISPOSAL.
       (a)    That part of the house sewer that extends from the City main sewer to within three (3) feet of the foundation shall be known as the building sewer and the size of the sewer shall not be less than the size prescribed by the Ohio Plumbing Code and fixture count.
   
   (b)   No private sewage disposal system shall be installed or maintained on property accessible to a sanitary sewer.
      (c)    Where a public sanitary or combined sewer is not available, the public sewer shall be connected to a private wastewater disposal system complying with the provisions established herein.
   
   (d)   Before commencement of the construction of a private wastewater disposal system, the owner shall first obtain a written permit, signed by the approving authority. The application for such permit shall be made on a form designated by the City, which the applicant shall submit with plans, specifications and other information as deemed necessary by the approving authority. A permit and inspection fee determined by the City shall be paid to the authorizing authority at the time the application is filed.
   
   (e)   A permit for a private household wastewater disposal system shall not become effective until the installation is completed to the satisfaction of the approving authority. The approving authority shall be allowed to inspect the work at any stage of construction and, in any event, the applicant for the permit shall notify the approving authority when the work is ready for final inspection and before any underground portions are covered. The inspection shall be made within five (5) normal City business days of receipt of notice by the approving authority.
   
   (f)   The type, capacities, location and layout of a private wastewater disposal system shall comply with all recommendations required by the approving authority and Chapter 3701-29 of the Ohio Administrative Code. No permit shall be issued for any private wastewater disposal system employing subsurface soil absorption facilities where the area of the lot is less than one (1) acre of ground. No septic tank shall be permitted to discharge to any natural outlet.
   (g)   At such times, as a public sewer becomes available to a property served by a private wastewater disposal system, a direct connection shall be made to the public sewer within thirty days after date of official notice to do so, and any septic tank or similar private wastewater disposal facility/facilities shall be cleaned of sludge and filled with suitable materials.
   (h)   The owner shall operate and maintain the private wastewater disposal facility/facilities in a sanitary manner at all times, at no expense to the City. Sludge removal from a private wastewater disposal system(s) shall be performed by a licensed sludge removal operator, and shall be disposed in accordance with the provisions of the operator's license.
   (i)   No statement contained in this section shall be construed to interfere with any additional requirements that may be imposed by the City.
