1175.05 EFFECT OF DISTRICT.
   (a)    Upon the effective date of an ordinance passed by City Council establishing a neighborhood conservation district, no new rental registration for single-family detached dwellings under Chapter 1197 shall be permitted. Any single-family rental property that registered prior to the effective date of the ordinance and maintains such registration current shall be allowed to continue use or occupancy of such single-family detached dwelling unit as rental property in accordance with the laws existing prior to the effective date of the ordinance establishing the district. No existing registered rental single-family detached dwelling unit in a district shall be considered to be a nonconforming use as a result of adoption of an ordinance creating the district. In the event an owner of rental property, either intentionally or unintentionally, allows a rental registration to expire and more than one (1) year passes without renewal of the rental registration, any subsequent use of the property must comply with the restrictions imposed by the district. It shall be the sole responsibility of the property owner to know the status of registration and to renew such registration prior to expiration.
   (b)    Notwithstanding the provisions of subsection (a) above, in each neighborhood conservation district created by this Chapter, the City shall make a record of the number of single family detached dwellings registered for rental under Chapter 1197 on the effective date of the ordinance creating that district. The number of single family detached dwelling registrations documented in effect on the effective date of the ordinance creating that neighborhood conservation district shall define the total number of permitted registrations of single family detached dwelling rentals allowed in that district. That documented number of total permitted registrations will be held available for permit registrations so long as the district continues to be a neighborhood conservation district as set forth herein. If registrations existing on the effective date of the ordinance creating the neighborhood conservation district expire, and are not renewed as specified in this Chapter, the expiring permit will be held available for a new single family detached dwelling rental registration, provided however, that at no time will the total number of single family detached dwelling rental registrations in any neighborhood conservation district exceed the total number of such registrations in existence on the effective date of the ordinance creating that district. With respect to neighborhood conservation districts existing on the date of this amendment, the number of available permitted registrations for rentals shall be the number of permitted registrations in said district as listed in the schedule set for in Section 1175.11 of this chapter.
   (c)    For all neighborhood conservation districts created prior to the enactment of subsection (b) above, said neighborhood conservation districts shall retain the same number of available single family detached dwelling rental units that existed on the date of the passage of this section.
