1337.02 PLANS, PERMITS AND FEES.
   (a)    Before work is commenced on the construction of a swimming pool or family pool or on any alteration, addition, remodeling or other improvement to a swimming pool or family pool, an application for a permit to construct and the plans and specifications and pertinent explanatory data shall be submitted to the Health Department for its approval, and no part of the work shall be commenced until the Health Department has further evidenced its approval by a suitable endorsement upon such plans and specifications. The Building Department of the City shall not issue a permit for building, plumbing, electrical work, sewer connections or other work in connection with the construction of a swimming pool or the construction of any alteration, addition, remodeling or other improvement to a swimming pool or family pool, nor shall issue a permit for a swimming pool until the plans and specifications therefor have been thus endorsed by the Health Department. The Health Department shall review such plans and specifications to determine whether they comply with the provisions of this chapter and with reasonable standards of swimming pool construction for the protection of the public safety, health and morals as prescribed in rules and regulations promulgated by the Health Department pursuant to this chapter.
   (b)    The application to the Health Department for a permit to construct a swimming pool or family pool or to construct any alteration, addition, remodeling or other improvement to a swimming pool or family pool shall be submitted on such forms and be supported with such information and data, as well as plans, specifications and pertinent explanatory data, as the Health Department may require pursuant to its rules and regulations promulgated hereunder.
   (c)    Before any permit is issued by the Building Division following the issuing of a permit by the Health Inspector of the Health Department the Building Division shall ascertain that any newly constructed swimming pool shall not be in violation of the Planning and Zoning Code or the Building Code and the area in which the swimming pool is to be constructed shall comply with all lot line regulations of the City. No swimming pool or appurtenant structures shall be located less than five feet to side property lines, or less than ten feet from the rear property line, nor shall any swimming pool be located in the front yard of any structure. No public swimming pool or appurtenant structure shall be located within twenty-five feet of any property line or road right of way.
   (d)    Health Permit Fees shall be in accordance with a schedule of fees adopted by the Board of Health. Building Division fees shall be in accordance with the schedule of fees as set forth in Chapter 1327 of the Codified Ordinances of the City of Steubenville, Ohio.
