1337.01 DEFINITIONS.
   For the purposes of this chapter, the following terms, phrases, words and their derivations shall have the meaning given herein. When not consistent with the context, words used in the present tense include the future, words in the plural number include the singular number and words in the singular number include the plural number. The word "shall" as used herein is mandatory and not merely directory.
   (a)    "City" means the City of Steubenville.
   (b)    "City Council" or "Council" means the City Council of the City of Steubenville.
   (c)    "Private residential swimming pools" means any swimming pool located at a three family or less dwelling, which is used for the exclusive use of the residents and the paying guests of such three family or less dwellings.
   (d)    "Public swimming pools" means any indoor or outdoor structure, chamber or tank containing a body of water for swimming, diving or bathing, other than a private residential swimming pool, intended to be used collectively by people for swimming or bathing, and operated by any person as defined herein, whether he be owner, lessee, operator, licensee or concessionaire, regardless of whether a fee is charged for such use.
   (e)    "Health Department" means the Board of Health, as well as the Director of the Board of Health and the personnel within such Board of Health of the City.
   (f)    "Building Division" means the Division of Engineering and Building Inspection of the City as well as the Building Inspector and any person working within the Division.
   (g)    "Person" means any person, firm, partnership, association, corporation, company or any organization of any kind.
   (h)    "Swimming pool" means a body of water in an artificial or semiartificial receptacle or other container whether located indoors or outdoors, used or intended to be used for public, semipublic or private swimming by adults or children, or both adults and children, whether or not any charge or fee is imposed upon such adults or children, operated and maintained by any person as herein defined, whether he be an owner, lessee, operator, licensee or concessionaire, exclusive of a family pool as defined herein, and shall include all structures, appurtenances, equipment, appliances and other facilities appurtenant to and intended for the operation and maintenance of a swimming pool, and also all swimming pools operated and maintained in conjunction with or by clubs, motels, hotels and community associations; subject, however, to the restriction that these regulations shall not be applicable to any such receptacle less than twenty-four inches deep, or having a surface area less than 250 square feet, except when such pools are permanently equipped with a water recirculating system, or involve structural materials.
