§ 130.01 LOITERING; PERSONS UNDER THE AGE OF EIGHTEEN.
   (A)   Definitions. For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      CURFEW HOURS. From 10:00 p.m. on the day prior to any day in which the St. Charles Public Schools are in session until 6:00 a.m. of the following day, and 11:00 p.m. to 6:00 a.m. on any other day.
      EMERGENCY. An unforeseen combination of circumstances or the resulting of a state that calls for immediate action. The term includes, but is not limited to: a fire; a natural disaster or automobile accident; or any situation requiring immediate action to prevent serious bodily injury or loss of life.
      GUARDIAN. A person who, under court order, is the guardian of the person of a minor, or a public or private agency with whom a minor has been placed by a court.
      MINOR. Any person under 18 years of age.
      PARENT. A person who is a natural parent, adoptive parent or stepparent of another person, or at least 18 years of age and authorized by a parent or guardian to have the care and custody of a minor.
   (B)   Loitering prohibited.
      (1)   No person less than 18 years old shall be in, or upon the public streets, alleys, parks, playgrounds or other public grounds, public places and public buildings, places of amusement and entertainment, or vacant lots during curfew hours; unless the person is accompanied by a parent, guardian or other adult person having the care or custody of the person.
      (2)   Each violation of this chapter shall constitute a separate offense.
