§ 92.064 PROCEDURE.
   (A)   Procedure. Procedure for obtaining a variance from the regulations of this subchapter is as follows:
      (1)   The property owner or agent shall file with the Zoning Administrator an application form together with the required exhibits plus a filing fee;
      (2)   The Zoning Administrator shall transmit the application directly to the Planning Commission for consideration at its next regularly scheduled meeting; and
      (3)   The Planning Commission shall, within 30 days of submittal of all required exhibits, recommend approval, denial or conditional approval.
   (B)   Standards. The Planning Commission may vary the regulations of this subchapter if all of the following requirements are met:
      (1)   The variance, including any conditions placed thereon, observes the spirit and intent of this subchapter to promote the public health, safety and welfare of the citizens of the City of St. Charles as well as ensuring the humane treatment of the animals; and
      (2)   Persuasive proof that the variance is compatible with the surrounding uses and property.
