(A) Annual inspection.
(1) The City Forester shall inspect all premises and places within the city as often as practical to determine whether any trees are public nuisances or whether a potential hazard to the livelihood of trees in the city exists.
(2) The Forester shall investigate all reported incidents of infestation by dutch elm fungus or elm bark beetles or oak wilt.
(B) Entering private property. The City Forester or a duly authorized agent may enter upon private premises at any reasonable time to carry out the assigned duties.
(C) Disease diagnosis.
(1) Upon finding conditions indicating dutch elm infestation or oak wilt, the City Forester shall immediately send appropriate specimens or samples to the Commissioner of Agriculture for analysis, or take other diagnostic steps recommended by the Commissioner.
(2) Except as provided in § 91.09 above, no action to remove infected trees or wood shall be taken until positive diagnosis of the disease has been made.
