§ 53.23 CONTAINERS.
   (A)   General requirement.
      (1)   Every householder, occupant or owner of any residence and any restaurant, industrial establishment or commercial establishment shall provide on the premises 1 or more containers conforming to the requirements of division (B) below to receive and contain all refuse which may accumulate between collections.
      (2)   All normal accumulations of refuse shall be deposited in those containers.
      (3)   Leaves, trimmings from shrubs, grass clippings, shavings and other rubbish of similar volume and weight may be stored in closed containers not meeting the requirements of division (B) below.
   (B)   Container requirements.
      (1)   All owners or occupants of dwellings, places of business or other structures other than manufacturing or industrial processing operations shall provide and keep on the premises containers sufficient for the storage of all refuse accumulated between collections.
      (2)   Each container shall be watertight; have a tight fitting lid; be impervious to insects, rodents, vermin, nonabsorbent of moisture; and shall not exceed 30 gallons in size except as otherwise provided in this part. Refuse may be placed in approved plastic bags outside of the required containers on collection days only for a period of not more than 24 hours.
   (C)   Placement.
      (1)   Containers shall be stored at the rear of premises or buildings in a manner so as to be out of view from the street in front of the premises.
      (2)   In no event shall containers be placed next to a street or curb or otherwise located in a way so as to unreasonably interfere with the use of adjoining property.
      (3)   Containers may be placed in the front of the dwelling or structures after 6:00 p.m. the night prior to the regularly scheduled garbage collection where placement will facilitate collection.
      (4)   The containers shall be removed from the front of the dwelling or building before 9:00 p.m. of the day of the collection.
   (D)   Temporary containers. Containers of cardboard, pasteboard, paper or other similar material shall not generally be used to contain refuse. Containers may on collection days be placed alongside approved containers for collection.
   (E)   Multiple dwellings and commercial structures. Structures intended for multiple-family use and commercial structures may provide approved refuse containers which exceed the 30-gallon size limit. Containers must have water-tight lids; be impervious to rodents, vermin and insects; and be constructed of metal, heavy rigid plastic or other suitable durable material.
   (F)   Industrial and manufacturing operations.
      (1)   Industrial and manufacturing operations which result in the production of industrial waste as defined above shall provide suitable containers for the containment and storage of industrial waste.
      (2)   Containers may be suitably adapted to the nature of the waste being stored, but must be sufficient to conceal the waste from view and be a suitable container to prevent spreading of the waste, and be of a materials so as to not produce unsightly, unhealthy or hazardous conditions.
      (3)   Containers may be stored in an area that will facilitate the manufacturing process; however, containers may not be placed in a way so as to interfere with public rights of way or create hazardous, unsightly or unhealthy conditions.
   (G)   Violation. Violation of this section shall be a petty misdemeanor.
