§ 52.04 BUILDING SEWERS AND CONNECTIONS.
   (A)   Written permission required. No unauthorized person shall uncover, make any connections with or opening into, use, alter or disturb any public sewer or appurtenance thereof without first obtaining written permission from the Superintendent.
   (B)   Classes.
      (1)   There shall be 2 classes of building sewer permits:
         (a)   For residential and commercial service; and
         (b)   For service to establishments producing industrial wastes.
      (2)   In either case, the owner or the owner's agent shall make application on a form furnished by the city, and reviewed by the City Building Inspector.
      (3)   The permit application shall be supplemented by any plans, specifications or other information deemed necessary by the Superintendent, or City Engineer.
      (4)   A permit and inspection fee for a residential or commercial building sewer permit and for an industrial wastes sewer permit shall be paid to the city when the application is filed, and the city or Building Inspector shall determine the fee.
   (C)   Costs. All costs and expenses incidental to installing and connecting the building sewer shall be paid by the owner. The owner shall indemnify or hold harmless the city against any liability directly or indirectly resulting from installing the building sewer.
   (D)   Separate, independent sewer required.
      (1)   A separate and independent building sewer shall be provided for every building, except where 1 building stands at the rear of another on an interior lot and no private sewer is available or can be constructed to the rear building through an adjoining alley, courtyard or driveway.
      (2)   In this situation, the front building and sewer may be extended to the rear building and the 2 considered as 1 building sewer; however, the city does not and will not assume any obligation or responsibility for damage caused by or resulting from any like single connection.
   (E)   Old sewers. Old building sewers may be used in connection with new buildings only when they are found to meet all requirements of this code on examination and test by the Superintendent or a representative.
   (F)   Other requirements.
      (1)   The size, slope, alignment, building sewer construction materials and the methods to be used in excavating, placing of pipe, jointing, testing and backfilling the trench, shall all conform to the State Building Code (M.S. §§ 16B.59 et seq,, as they may be amended from time to time), city water system provisions and other applicable city code provisions.
      (2)   In addition to these code provisions, the materials and procedures set forth in appropriate specifications of the American Society of Testing Material (ASTM) and Water Pollution Control Federation (WPCF) Manual of Practice No. 9 shall apply.
   (G)   Sewer level. When possible, the building sewer shall be brought to the building at an elevation below the basement floor. In all buildings in which any building drain is too low to permit gravity to the public sewer, sanitary sewage carried by a building drain shall be lifted by an approved means and discharged to the building sewer.
   (H)   Down spouts, drains and other runoff. No person shall directly connect roof down spouts, foundation drains, areaway drains or other sources of surface runoff or groundwater to a building sewer or indirectly connect to a public sanitary sewer unless the connection is approved by the Superintendent for polluted surface drainage.
   (I)   Connection regulations.
      (1)   The connection of the building sewer to the public sewer shall conform to the Building Code, water system ordinances and other applicable city rules and regulations, or the procedures set forth in appropriate specifications of the ASTM and the WPCF Manual of Practice No. 9.
      (2)   All like connections shall be made gastight and watertight and verified by proper testing. Any deviation from the prescribed procedures and materials must be approved by the Superintendent or a representative before installation.
   (J)   Inspection. The applicant for the building sewer permit shall notify the Superintendent when the building sewer is ready for inspection and connection to the public sewer. The connection and testing shall be made under the supervision of the Superintendent or a representative.
   (K)   Excavation.
      (1)   All excavations for building sewer installation shall be adequately guarded with barricades and lights to protect the public from hazard.
      (2)   Streets, sidewalks, parkways and other public property disturbed in the course of the work shall be restored in a manner satisfactory to the city.
