§ 51.09 CURB BOXES AND SERVICE LINES.
   (A)   (1)   It shall be the responsibility of the city to make any mechanical repairs necessary for the proper functioning of the curb boxes and curb stops. This responsibility shall include, but not necessarily be limited to the straightening, raising or lowering of curb boxes upon the written request of the water user on whose property the box is located.
      (2)   If the city is making repairs to a curb box that is located in a driveway, the city will be responsible for the moving of the curb box out of the driveway, if necessary. The expense will be the city's, however, the property owner will be responsible for expenses of repairs to the driveway and landscaping.
   (B)   It shall not be the responsibility of the city to determine whether repair or adjustment is needed.
   (C)   The costs of all such maintenance and repair of curb boxes or stops shall be the expense of the city. If it is determined that the repair or maintenance was required due to faulty materials or faulty installation, the city may require the property owner to pay for all or a portion of the expense.
   (D)   Replacement of landscaping, paved or concrete driveways, walkways, steps or other permanent structure shall be the responsibility and expense of the property owner.
   (E)   From this date of adoption forward, no service or water shutoff shall be installed under concrete walks, steps, driveways or other permanent structures, either existing or contemplated, between the property line and the building to be supplied. Exceptions may be granted by written approval of the City Engineer.
   (F)   It shall be the responsibility and expense of the property owner to maintain the service line from the curb box into the house or building. The expense shall not include the curb box. In case of failure upon the part of any property owner to repair any leak or malfunction occurring in the service line within 24 hours after written notice has been given to the owner or occupant of the premises, the water will be shut off and will not be turned on until repairs are made and the sum as established by ordinance of the City Council has been paid.
   (G)   When the waste of water is great or when damage is likely to result in a leak, the water will be turned off if repair is not commenced immediately upon the giving of such notice.
