§ 156.55 HARDSHIP VARIANCE OR WAIVER.
   (A)   General. Where the Council finds that extraordinary hardships may result from strict compliance with one or more portions of this chapter, it may vary or waive those portions of the section upon specific request by the subdivider so that substantial justice may be done and the public interests secured. This is provided that such variation or waiver will not have the effect of nullifying the intent and purpose of the code or of the master plan. A request for such variance shall be submitted in writing at the time the preliminary plat is filed with the city.
   (B)   Conditions of variance. In granting variance and modifications, the Council may require such conditions as will, in its judgment, secure substantially the objective of the standards or requirements so varied or modified.
