For the purpose of this chapter, the following definitions apply unless the context clearly indicates or requires a different meaning.
BOULEVARD. The portion of the street right-of-way lying between the property line and the edge of the traveled street.
BUTT LOT. A single lot at the end of a block which is located between two corner lots.
COMPREHENSIVE GUIDE PLAN. A plan accepted by the City Council to be used as a guide in determining future land use and other general aspects of the city, and includes any unit or part of such a plan separately adopted in any amendment to said plan or part thereof.
EASEMENT. A grant of an interest in land by an owner for the specific use of said land by the public generally or by another person or persons.
ENVIRONMENTALLY SENSITIVE AREAS. Those areas that have 12% or greater slopes, land or soils subject to flooding, wetlands (including streams, ditches, drainage ways, ponds and marshes), high water table, woods and soils that are unsuitable for building sites. In the areas where severe development limitations exist, as determined by the city, there shall be detailed examinations and careful study should proceed before any type of development is allowed to be constructed. The goal is to provide for the orderly and harmonious physical development of the city.
MINOR SUBDIVISION. The division of a lot, tract or parcel of land into two lots, tracts or parcels.
OWNER. Any individual, firm or other legal entity having sufficient proprietary interest in the land to commence and maintain proceedings to subdivide under this chapter.
PRELIMINARY PLAT. The preliminary document which indicates the proposed layout of the subdivision to be submitted to the Park/Planning Commission and Council for consideration.
PRELIMINARY SKETCH PLAN. The preliminary document, drawn roughly to scale end submitted prior to the preliminary plat, which indicates in a general manner the proposed subdivision to be submitted only to the Park/Planning Commission.
RESTRICTIVE COVENANTS. Those contracts entered into between parties constituting restrictions on the use of property within the subdivision for the benefit of property owners and which provide a mutual protection against undesirable aspects of development which would tend to impair the values of the properties.
SETBACK LINE. A line within a lot, as designated on the preliminary plat or within the language of Ch. 157 of this code of ordinances, between which line and the adjacent street right-of-way line or adjacent property line the erection of a structure is prohibited.
STREETS. All public thoroughfares whether designated as streets, highways, roads, avenues, boulevards or however otherwise designated on maps, plats or drawings. In the broad sense of the term, the definition shall mean that portion lying within the right-of-way lines of any public property used for street purposes whether or not actual title rests with the public or by easement.
(1) ACCESS STREETS OR SERVICE ROADS. Minor streets which are parallel to and adjacent to arterial streets and which provide access abutting properties while maintaining protection from through traffic.
(2) ARTERIAL STREETS AND HIGHWAYS. Those streets used primarily for fast or heavy traffic and which may or may not have limited access.
(3) COLLECTOR OR FEEDER STREETS. Those which carry traffic from minor streets to the system of arterial or major streets and include the principal street of a residential development.
(4) CUL-DE-SACS. Minor streets with only one outlet and on which provision has been made for the turning around of vehicles at the end opposite from the entrance outlet.
(5) MAJOR STREETS. Heavily traveled streets of considerable continuity and which are used primarily for intercommunication between large areas.
(6) MINOR STREETS. Those used primarily for access to the abutting properties.
SUBDIVIDER. Any person, firm or other legal entity commencing proceedings under this chapter to effect a subdivision of land for themselves or for another.
SUBDIVISION. The division of a lot, tract or parcel of land into three or more lots, plats, sites or other divisions of land.
WIDTH OF LOT. The lot’s mean width measured at the building setback line.
