No person or firm shall construct any railway or spur railway line within the limits of the city without the express approval of plans by the Council. However, such trackage may be constructed on any land owned by a railway company at the time of the effective date of this chapter unless such land has been sold to another person or firm, who or which is not a railway company, between the effective date and the time of construction.
