1165.02 OVERLAY DISTRICT.
   The "PUD" shall be applied as an overlay district on top of existing established zoning districts that govern land use, setbacks, site density, and other land use controls. Provisions of the underlying zoning district shall apply unless altered or superseded by the Planning Commission and Council approval of a "PUD" on a specific parcel or parcels of land as established by this Chapter.
   Approval of a "PUD" and its provisions will be based on the proposed developments ability to meet the spirit and intent of the purposes for the specific type of "PUD" as stated herein. If the desired land use deviates significantly from the underlying zone, a zone change in both the underlying zone and the. request for the establishment of a "PUD" must be applied for at the same time.
