1345.08 FLAME RESISTANCE.
   (a)   All Portable Structures and or Tents used for assembly or in which animals are stabled and which exceed 2,400 square feet in area, and all tarpaulins and decorative materials in connection with any of these, shall be of flame resistance material, or treated with an approved chemical solution rendering them flame resistance. A test shall be made of the portable structure and or tent by the Department of Fire prior to the erection and on the decorative or other materials before they are attached to or placed therein. In lieu of such tests, the Fire Chief may accept a certificate from the manufacturer that the material has been tested by Underwriters Laboratories, Incorporated, or meets the requirements as specified in the federal specification for fire, water and weather resistant cotton duck, CCC-D-746, or he may accept the reports of tests made by other administrative officials or a recognized testing laboratory as evidence that the tents, tarpaulins and decorations have the required resistance to fire.
   (b)   All portable structures and or tents used for assembly or in which animals are stabled and which do not exceed 2,400 square feet in area, need not be of flame resistance materials. During all times of occupancy such non-flame proofed portable structures and or tents shall have not less than 20 percent of the side curtain area removed on either side or either end of the tents or otherwise arranged to provide the required open area. The aggregate open area shall be not less than 40 percent of the total side curtain area.
   (c)   All portable structures and or tents used for assembly or in which animals are stabled and which are of less than 1,200 square feet in area need not be of flame resistance materials and need not have the required open side curtain area as prescribed in subsection (b). During times of occupancy such tents shall be provided with means of egress as contained in Section 1345.09(a).
