(a) Temporary Enlargements. The use of cut-outs and extensions is not permitted.
(b) Location. No outdoor advertising sign shall be constructed:
(1) As a roof sign;
(2) With two separate sign faces facing in the same direction and with a combined sign face area of more than 150 square feet.
(3) With a face area exceeding 14 feet in height x 48 feet in length (672 square feet);
(4) Within 660 feet of the right of way line of any street or highway;
(5) As a ground sign more than 40 feet above the grade of the lot or location being occupied by such sign, or the average natural grade at the sign location, if higher. In the case of a street or highway which is higher than the grade of the lot or location to be occupied by the sign, the height shall be measured from the center line of pavement at such location, but in no event shall the height exceed forty feet above the center line of the pavement at that location.
(c) Spacing Criteria. An affidavit certifying compliance with the spacing requirements stated below must be provided by the applicant. Measurement shall be computed along the edge of the street right of way between points directly opposite the center of the sign(s) along the same side of the expressway, roadway, or street on which the sign is located.
(1) Expressways and Freeways. No outdoor advertising sign shall be constructed within 1,000 feet of any other outdoor advertising sign located on the same side of I-75 and facing the same traffic flow.
(2) Major Arterial Roadways. No outdoor advertising sign shall be constructed within 1,000 feet of any other outdoor advertising sign located on either side of the highway (Major Arterials designated on the Thoroughfare Plan of Hamilton County) and facing the same traffic flow.
(3) Minor Arterial Roadways and Collector Streets. Poster signs and Junior Panels shall be spaced not less than 500 feet from another outdoor advertising-sign located on either side of the highway (Minor Arterials and Collectors designated on the Thoroughfare Plan of Hamilton County) and facing the same traffic flow.
(d) Buffer Spacing. An affidavit certifying compliance with the spacing requirements stated below must be provided by the applicant. Measurement shall be computed along the edge of the street right of way between points directly opposite the center of the sign(s) along the same side of the expressway, highway, or street on which the sign is located.
(1) Distance from Residences. No outdoor advertising sign shall be located within 500 feet as measured along the thoroughfare from which the sign is intended to be viewed, of any parcel located in a residential district.
(2) Location of Advertising for Tobacco and Alcohol Products. No outdoor advertising sign any tobacco product or alcoholic beverage, whether constructed prior to or since the adoption of this Resolution, shall be located within 500 feet in any direction of any school.
(e) Multiple Message or Variable Message Outdoor Advertising Signs. Multiple message or variable message outdoor advertising signs are not permitted.
(f) Cap and Replace.
(1) In order that the total face area and number of faces of outdoor advertising signs not be increased, no person shall construct an outdoor advertising sign without first removing outdoor advertising signs equal in face area and number of faces.
(2) In order to administer this provision, the Zoning Inspector shall issue a replacement permit to any person who permanently removes a lawfully existing outdoor advertisement sign.
(3) The Zoning Inspector shall note on the replacement permit the number of faces and face area, up to a maximum of 672 square feet. Replacement permits may be transferred. No construction permit shall be issued unless the applicant tenders for cancellation a replacement permit or permits with the total face area and number of faces noted of at least the area and number of the sign faces to be constructed. Provided, further, no construction permit shall be issued unless the newly constructed outdoor advertising signs will also meet requirements of subsections (b), (c) and (d). Provided, however, that any outdoor advertising sign located on I-75 that is replaced under this provision, may be relocated along I-75 within 300 feet of the right of way line of I-75 so long as it otherwise complies with the requirements of subsections (b), (c) and (d) hereof.
