(a) Whoever violates any provision of this chapter is guilty of a misdemeanor of the fourth degree. Whoever has been previously convicted of a violation of this chapter or of Ohio R.C. 2927.02 or a similar municipal ordinance shall be guilty of a misdemeanor of the third degree.
(b) Whoever violates any part of subsection 535.02(c) “Possession and use by minors” is guilty of a minor misdemeanor. If the offender previously has been convicted of a violation of this subsection, they shall be guilty of a misdemeanor of the fourth degree.
