523.04 REMOVAL OF PUBLIC NUISANCE; SERVICE.
   (a)   Whenever such a public nuisance exists, the Director of Public Service and Safety or the Sanitarian shall give notice to the owner of the real property whereon such public nuisance exists to abate or remove same. Such notice and order shall state:
      (1)   The nature of the public nuisance;
      (2)   A description of and location of the public nuisance;
      (3)   A statement that the public nuisance must be removed from the premises within ten days after service of such notice and order, or the same will be removed by the Director;
      (4)   A statement of the penalties provided for noncompliance;
      (5)   A statement that the property owner will be assessed the cost incurred by the Village in removing and storing the public nuisance; and

      (6)   A statement that any request for a hearing must be made to the Director, within ten days after the service of such notice and order.

   (b)   Such notice and order shall be served by the Director either by certified mail with return receipt requested, or by personal service, to the owner of the property or person having the right to the possession of the property on which the nuisance is or can be found.
   (c)   Should the owner of the property or person having the right to the possession of the property, within ten days after receipt of the Director’s notice and order, notify the Director that the inoperable vehicle is either an abandoned vehicle or an abandoned junk motor vehicle which has been left on his or her property without permission of the person having the right to possession of the property, and requests removal thereof, the Director shall cause the removal of such vehicle pursuant to Ohio R.C. 4513.60 or 4513.63 respectively.
   (d)   An owner or person having the right to possession of the property listed as a nuisance in the order, may within ten days after service of the notice provided for herein, request in writing a hearing before the Nuisance Review Board. If a hearing is requested, such hearing shall be held before the Board within ten days of such request for hearing.
   (e)   In the absence of a request for a hearing or compliance with notice and order, the Director shall, at the expiration of the ten day period provided in the notice and order, shall remove and or abate such nuisance for the preservation of the life, health, comfort and safety of the public.
   (f)   The Nuisance Review Board shall consist of three members to include the Director of Public Service and Safety, the Director of Planning and the Building Commissioner.
   (g)   After such hearing the Nuisance Review Board shall determine and rule whether or not such items listed in the order are a public nuisance. Upon determination by the Board that the items listed in the order constitute a public nuisance, it shall be removed or abated.
   (h)    Any appeal from a decision of the Board shall be made pursuant to Ohio R.C. Chapter 2506. (Ord. 35-1992. Passed 8-6-92; Ord. 24-2019. Passed 12-17-19.)
