16-3-6 LANDSCAPE WASTE DUMPING AUTHORIZED.
Citizens of Staunton are hereby authorized, in accordance with the provisions of this Section, to deposit their own residential Landscape Waste at the City's lagoon property located at 1217 Bunker Hill Road, Staunton, Illinois. Deposits are to be made outside the entrance gate on top of the existing pile located just Southeast of the entrance grate in the small clearing next to the drive.
   Staunton residents interested in dumping Landscape Waste shall first be required to secure a license allowing for same from City Hall. Individuals who apply and pay for a permit to dump shall receive an annual permit in the form of a sticker, which shall be good from January 1 through December 31 of the year in which the permit was issued. Fees for permitted dumping hereunder shall be Fifteen Dollars ($15.00) per year, subject to future modification by the City Council.
   The lagoon dump site shall be secured by fence and locked gate and dumping as provided for herein shall only be permitted during hours established by the City Council. Dumping occurring outside of the permitted hours or in any way in violation of the requirements of this Section, shall subject the offender to prosecution and fines as provided established herein, and shall result in the forfeiture of the annual permit if one was previously issued to the offending party. The initial permitted days/hours shall be on Wednesdays and Saturdays from 8:00 A.M. to noon, provided the gate is unlocked and the dump location is open.
   The permit issued shall apply on a per-household basis. Proper identification shall be shown by any individual entering the lagoon premises, and the individual seeking to dump Landscape Waste must be an immediate family member of the permit holder and residing at the same address as noted on the permit so issued.
   The City reserves the right to contract with entities performing landscaping, yard waste removal, tree trimming or related services generating Landscape Waste, to allow those entities to deposit Landscape Waste at the City's lagoon property, and notwithstanding any other provision of Chapter 16 of the Staunton Revised Code, the City exempts itself from the Open Burning Regulations contained therein. Contracts with any such entity shall contain provisions requiring payment of not less than One Hundred Dollars ($100.00) per load of Landscape Waste, which load shall be not more than seven (7) cubic yards. Entities wishing to make commercial dumps of Landscape Waste shall fill out all necessary documentation at City Hall prior to dumping the Landscape Waste, and shall fulfill all associated requirements of the City addressed in said documentation as a condition of being allowed to deposit Landscape Waste at the City lagoon. No materials other than Landscape Waste as defined in this Article shall be deposited by any individual or entity. No resident shall be allowed to deposit Landscape Waste from property other than their own. No bags or containers may be left behind. Only bio-degradable waste shall be deposited. No grass cutting/bagged-grass dumping shall be permitted. No construction materials, bricks, stone, treated lumber or treated landscape timber, fence wire, fabric, plastic of any kind, planters, steel, iron, agricultural waste, garbage or household trash, junk, refuse, tires, paint cans, solvents or other bio-hazards or EPA controlled waste substances are permitted. Violations of Chapter 16 of the Staunton Revised Code of Ordinances are punishable in accordance with the City's standard penalty provisions for Ordinance Violations or such additional charges as may be appropriate depending on the violation occurring, and for Ordinance Violations shall subject the violator to daily fines ranging from One Hundred Dollars ($100.00) to Seven Hundred Fifty Dollars ($750.00), per occurrence, for each day the violation continues.
