(A) Public and community facilities are herein considered to be buildings or land devoted to public or semi-public (e.g., social clubs) use including telecommunication towers and open space.
(B) Because public and community facilities are permitted in several zones, their general requirements are listed herein. Specific requirements such as lot size and building dimensions are presented in § 154.099, Dimensional and bulk standards - community buildings. These requirements shall prevail in all zones, unless superseded by the requirements of said zone.
(C) Buildings and lands designed, intended or constructed to accommodate more than 25 persons at any one time, such as schools, churches, libraries, building belonging to social and civic organization, state-licensed day care and residential care facility, shall meet the following conditions in addition to those required by the zone in which they are located:
(1) The site shall abut a collector or arterial street or be located such that significant traffic will not be generated on local residential streets;
(2) Pick-up and drop-off areas shall be included and shall be designed so as not to impede regular vehicular traffic and so as to enhance vehicular and pedestrian safety; and
(3) Buffering at least ten feet wide consisting of densely planted shrubs and trees shall be provided at sites with sports activities to mitigate noise and adverse visual impacts on adjacent residential properties (golf courses are excluded from this requirement):
(D) State-licensed day care facility serving from 13 through 16 persons and residential care facility serving from seven through 16 persons shall:
(1) Provide off-street parking for a minimum of five vehicles or for the number of vehicles parked 24 or more consecutive hours, whichever is greater; and
(2) Set back outdoor play (recreation) areas at least 15 feet from any lot line which abuts a residential parcel.
(E) Open spaces, whether required by a zone or voluntary, shall meet the following:
(1) The design and location of the open space site as well as its landscaping, and recreational furniture shall serve one or more of the following functions:
(a) Provide opportunities for outdoor recreation;
(b) Provide contrasts to the built environment;
(c) Preserve scenic qualities;
(d) Protect sensitive or fragile environmental areas;
(e) Enhance and protect the values and functions of trees and forest;
(f) Preserve the capacity and water quality of the storm water drainage system; and
(g) Provide pedestrian and bicycle transportation connections.
(2) Open space within a development shall consist of one parcel broken only by streets or pathways.
(3) Open space in excess of four acres and providing for outdoor recreational opportunities shall:
(a) Meet the requirements in § 154.080(B).
(b) Provide off-street parking for four vehicles per acre of open space (golf courses are excluded from this requirement).
(4) Open spaces shall be the property of the development’s homeowners association. Such association shall assume the responsibility of developing, maintaining, preserving, policing and insuring said open space. The association shall have the power to assess property owners within the development for the development, maintenance, preservation, policing and insurance of said open space.
(F) Telecommunications towers shall meet the following conditions in addition to those imposed by the zone in which they are located:
(1) Amateur towers.
(a) Towers supporting amateur radio antennas shall conform to Motorola R56 Quality Standards.
(b) They may be allowed in the rear yard of residential parcel provided the height of the tower does not exceed the distance between the tower base and the nearest property line.
(2) Commercial towers.
(a) Towers supporting commercial antennas shall conform to Motorola R56 Quality Standards and to all applicable provisions of § 154.099(A)(8).
(b) Commercial towers may be allowed provided the height of the tower does not exceed the distance between the tower base and the nearest property line.
