§ 154.078 SPECIAL USE (PRIOR AND GRANDFATHERED).
   (A)   The basis under which any site can be designated as a special use must be verified through either a prior continuous use or a prior documented periodic use unique to an individual lot or specific lot of land as defined by an original recorded subdivision plat. To be considered a periodic use, the lot or lot shall have been used for that purpose at least once during the past three years.
   (B)   Special use allows for the maintenance, improvement and replacement of those existing facilities that support a special use as required to conform to safety and general use needs.
   (C)   The intent of a special use designation is not to terminate the existing use, but to provide for permanent continuation of the use. Expansion of, addition to or other uses on each unique lot or lot of land would be through the town ordinances and the Planning and Zoning Board’s processes designed for the modification or addition of a use.
   (D)   No other uses of any nature are granted under this provision.
   (E)   The special use prior and grandfathered is acknowledged and granted within the confines of the town code. Those lots or lots that are approved for special use (prior and grandfathered) are identified in Appendix C at the end of this chapter.
