§ 154.009 ENFORCEMENT AND FINES.
   (A)   Enforcement. The town shall enforce, by any proceeding at law or in equity, all provisions of this chapter.
      (1)   Remedial action may require removal of structures or improvements to property that are in violation. Failure to remove the structure or improvements, if directed to do so by the town, shall be an infraction.
      (2)   The town shall issue written notifications of infractions or violations resulting in fines. The town at its sole discretion may issue warnings instead of citations as it deems proper.
      (3)   Each day, starting on the thirty-first day following the date of the notification by certified mail that an infraction exists shall constitute a separate violation.
   (B)   Fine schedule. 
      (1)   The following infractions by owners, employees of owners or agents of owners within the town shall result in fines.

      (2)   In addition to enforce any of said provisions, including the defense of any said provisions, the town shall be entitled to recover its legal fees and expenses in the event that a court shall determine that an owner has committed one or more violations of said requirements or to restrain a violation thereof.
