§ 150.060 BUILDING CONSTRUCTION AND SITE REQUIREMENTS.
   Any new building construction and site development and any exterior modifications or changes to an existing building or site for which a permit is issued upon adoption of this subchapter are subject to requirements of Chapter 150, Buildings, Chapter 154, Zoning, and if applicable, Chapters 151 and 152, Annexations and Subdivisions.
   (A)   No building permit will be issued until the plans and specifications showing the nature, kind, shape, heights, materials and location of same shall have been submitted to and approved by the Planning and Zoning Board and the Town Building Inspector. Before construction begins, the approved permit shall be posted in a visible location at the job site and remain posted until an approved final inspection for the work has been issued to the permit holder.
   (B)   Any change from the approved plans requires submission of written request and town approval prior to proceeding with change and to be approved by the town’s Building Inspector.
   (C)   All new building construction or building modification, change, shall meet the requirements of the state, the county and the town. The plans and/or specifications shall display in a prominent location that “all construction will meet or exceed the requirements of the 2018 edition of the IRC and/or IBC.”
   (D)   Structure activities that generate noise will be limited to the hours between 7:00 a.m. and 8:00 p.m.
   (E)   During the period of new construction, no part of the building under construction or structures of temporary nature, trailers, basement, tent, shack, garage for other outbuildings shall be used at any time as a dwelling or sleeping quarters. The dwelling shall not be lived in until an acceptable final construction inspection has been completed and the report furnished to the town.
   (F)   The building area, square feet, for all new dwellings, garages and accessory building structure shall be noted on the plans, along with setbacks, and any recorded easements.
   (G)   All new structures or roof replacements to existing structures, roofing materials used shall be applicable to the town’s Building and Construction Codes identified in Chapter 150, Buildings. Class A roof coverings are required; wood roof coverings are not allowed. Typical types of Class A roofing products include, but are not limited to: Asphalt Shingles, Stone-Coated Metal, Metal, Concrete (light and standard weight), Clay Tile, Synthetic and Hybrid Composite.
   (H)   All structural building material shall be new. Recycled material can be used for aesthetics.
   (I)   Spark arrestors shall be placed on all chimneys except those used exclusively for venting a propane or natural gas burner.
   (J)   A properly maintained portable toilet shall be in place prior to beginning excavation work or construction unless prior arrangements have been approved by the town.
   (K)   Building sites shall be maintained, clean and free of debris. A vehicle or container dedicated to debris removal shall be maintained on site all times during construction. Debris shall be disposed by the owner to a location outside of the town.
   (L)   It is the owner’s responsibility to establish all property boundaries and sign an affidavit stating that all survey markers have been found. Survey markers shall be located or established at all corners of the property or parcel and the markers shall be further identified minimum three-foot high post or lath placed adjacent to the survey markers with the top one foot painted with a bright color, prior to the construction of the primary residence, residence additions including decks or outbuildings. All new single-family residences must acquire a certificate of placement form a licensed state surveyor before footings are poured. The marking of the corners of the property may be waived if the project leaves the existing structure footprint(s) unchanged.
   (M)   Construction materials, portable toilet, construction vehicles and equipment shall be confined to the construction site. Trespassing on or damage to neighboring properties is not permitted.
   (N)   Location of propane tanks shall be shown on the plot plan, shall comply with the minimum setback lines, and shall be a minimum of ten feet from any residential structure.
   (O)   Any changes to the grade of the land on a lot or parcel shall be maintained as to prevent additional deposits of settlement upon adjacent streets, adjoining lots or common areas. Driveways must be constructed in a manner that does not impede existing drainage from the road service. The owner is responsible for installing any culverts or other device necessary to ensure the drainage water is not forced to move from the ditches to the roadway because of the driveway installation.
   (P)   All retaining walls or facings with a total projection in excess of four feet shall be designed as structural members keyed into stable foundations capable of sustaining the design loads, and shall be designed by a civil or structural engineer registered in the state.
   (Q)   Any footings, foundation or excavation left open and unattended for longer than 30 calendar days shall be secured by a minimum, temporary chain-link panels six feet in height and secured to prevent entry and fall over.
   (R)   Any building or structure shall be finished or prosecuted to completion within two years of issuance of an approved building permit. Completion includes removal of construction debris, final grading of land and in the case of a new dwelling or accessory building structure, an approved final building inspection.
   (S)   A building permit may be extended by the Planning and Zoning Board if the application for an extension is received by the town at least 30 days before the original building permit expires. The extension application shall include a description of the work to be completed, a work plan, and a schedule for completion of the work. The length of any extension is one year. If the construction is not completed at the end of the extension, a new permit must be applied for and the applicant must comply with any and all changes/upgrades to the building ordinance and/or building codes.
